Personal Loan Settlement in India: Process & RBI Rules

Personal loan settlement means your bank or NBFC agrees to accept a smaller one-time amount to close an unpaid personal loan. It is not automatic: the lender decides, there is no fixed percentage, and the loan is usually shown as "settled" on your credit report. Below: the process, the pros and cons, and how we help.

You decide every step

When personal loan settlement is considered

  • Your personal loan EMIs take too much of your monthly income
  • You lost your job, fell ill or your business income dropped
  • You took loans from banks, NBFCs or loan apps and cannot pay them all
  • Missed EMIs have brought penalty charges and recovery calls

Your options before personal loan settlement

  • If you can still pay something, first ask for a lower EMI or a longer loan period (restructuring)
  • If full payment is not possible, ask the lender about a one-time personal loan settlement
  • We help you write a hardship letter and collect proof for the lender
  • If your lender is a loan app, we help you find the bank or NBFC behind it

Personal loan settlement process, step by step

  1. Check your numbers. Outstanding amount, EMIs missed, and what you can pay as a lump sum or in a few parts.
  2. Talk to the lender in writing. Explain your hardship and ask about a one-time settlement or an easier repayment plan.
  3. Let the lender decide. RBI asks banks and NBFCs to follow their own board-approved policy for settlements. There is no fixed percentage.
  4. Get the offer letter first. It should show the amount, the due dates and that the account will be closed after payment. Pay only after you have it.
  5. Pay only the lender. Use the lender's official account, never a personal account or UPI ID.
  6. Collect the NOC. Keep the no-dues certificate and check your credit report later.

Credit report: a settled loan is usually reported as "settled", not "closed". This can affect future loans. Settlement does not improve your CIBIL score. See loan settlement vs loan closure and NOC after settlement.

If the settlement amount is paid over more than three months, RBI treats it as restructuring.

A simple example (not a typical or promised figure)

Suppose someone owes ₹3 lakh and cannot keep up after a job loss. A lender might agree in writing to accept ₹1.5 lakh as a full and final settlement. That number is only an illustration — not a client result and not something anyone can promise. The lender alone decides whether to settle and for how much.

When personal loan settlement may make sense

  • You lost your job or business income.
  • You had a long illness or medical emergency.
  • You are many months behind and cannot catch up.

If you can still pay in full over a longer time, ask about restructuring first. It usually affects your credit report less. Read restructuring vs settlement.

Documents to keep ready

  • Loan agreement or sanction letter
  • Latest statement of account
  • Proof of hardship (job loss letter, medical bills, business records)
  • Income proof and bank statements
  • ID proof, shared only with the lender through official channels

Mistakes to avoid

  • Paying a "settlement" into an agent's personal account.
  • Trusting anyone who promises a fixed waiver.
  • Ignoring legal notices.
  • Using money you need for a secured loan EMI to settle an unsecured loan.

Common Questions

Is personal loan settlement good or bad?

It is a last option, not a first one. It can end a loan you cannot repay for less than the full dues. But the loan is usually shown as "settled" on your credit report, which can make new loans harder for some time. If you can pay with a lower EMI, ask for that first.

How long does personal loan settlement take?

There is no fixed time. It depends on the lender's own process and how quickly you share documents. Do not trust anyone who promises a fixed timeline.

What do RBI guidelines say about personal loan settlement?

RBI's June 2023 rules let banks and NBFCs settle loans under their own board-approved policies. They do not give any borrower a right to a settlement. You can read RBI notices at rbi.org.in.

Can the lender take legal action if I do not pay my personal loan?

Yes. A lender can send a demand notice and can start arbitration or a court case to recover its money. If a cheque or auto-debit bounced, there may also be a case under the law for that. Recovery agents still must not harass you. If you get a notice, do not ignore it.

Should I stop paying my EMIs to get a settlement?

No. If you stop paying what you can afford, you get more penalties and the lender may take legal action. Settlement is only for people in real hardship. Talk to us or your lender first.

What percentage will a bank or lender settle for?

There is no fixed percentage. RBI's June 2023 rules ask every bank and NBFC to set how much of a dues amount it can reduce in its own board-approved policy, so the figure depends on the lender, your account and what you can pay. We do not quote or promise any percentage, and no one else can promise one for a lender.

Can a personal loan defaulter get a settlement?

A defaulter can ask for one. Lenders usually consider settlement only when the account is overdue and you can show real hardship, such as job loss or illness. The lender decides under its own board-approved policy, and the loan is usually reported as "settled". Get the offer in writing before paying.

Can I go to jail for not paying a personal loan?

Not being able to pay a personal loan is generally a civil matter. The lender can send notices and start arbitration or a civil case to recover its money. A criminal case can arise only in specific situations, for example a bounced cheque or an intention to cheat. If you get any notice, do not ignore it.

Will settlement affect my credit report?

Usually, yes. A settled account is normally shown on your credit report (CIBIL) as "settled" and not "closed". This can lower your score and make it harder to get a new loan or card for some time. Settlement does not improve your CIBIL score. We explain this before you decide.

Can I settle a personal loan without missing EMIs first?

Some lenders discuss restructuring or settlement only after an account becomes overdue; others consider a documented hardship request earlier. If you are still paying, ask about restructuring or a longer tenure first.

Will settling my personal loan stop recovery calls?

Once the settlement is agreed and paid in full, the lender should stop collection on that account and issue a No Dues letter. While you negotiate, calls may continue, but they must follow RBI rules, including no calls before 8 AM or after 7 PM.

Can I take a new loan after settlement?

Possibly, but it is usually harder for a while because the account is reported as "settled". RBI's June 2023 framework also sets a cooling period before the same lender lends to you again.
