What a settlement company can and cannot do

Whether to settle, and for how much, is decided by the lender. Under RBI's June 2023 framework, each bank and NBFC acts within its own Board-approved policy. No outside company can force a lender to agree, so any promise of a result is a promise about something the company does not control.

A genuine consultancy can explain your options, help you organise documents, prepare you for the conversation, and communicate with your lender with your permission. It cannot guarantee an outcome, remove accurate information from your credit report, or make a lawful legal process disappear.

Red flags

Be careful if a company or agent does any of the following:

  • Guarantees a settlement, a percentage waiver or a result before the lender has said anything in writing.
  • Asks you to send settlement money to the company, its personal account or a personal UPI ID, instead of the lender's own account.
  • Asks for a large upfront fee without written terms, or will not say what happens to the fee if the lender declines.
  • Tells you to stop talking to your lender or to ignore notices. Notice deadlines keep running.
  • Claims it can delete a "settled" status or accurate negative history from your credit report.
  • Asks for OTPs, banking passwords, card PINs or access to your phone. No genuine service needs these.
  • Pressures you to decide within hours, or refers to special contacts inside the lender that you cannot verify.
  • Gives you nothing in writing.

The risks a lender itself points out

Bajaj Finserv, in its guide on the impact of loan settlement, lists risks of using a third-party settlement service. They include paying a fee even if the lender does not agree to a settlement, delays in responding to your lender that can push you past a notice deadline, sharing your details with an unverified party, and advice that misstates what settlement means for your credit report. It advises you to verify the settlement terms, payment requirements and deadlines directly with your lender.

That is one lender's view, but it is sensible advice for any lender.

Questions to ask before you agree

Ask these, and expect clear written answers:

  • What exactly will you do for me, and what will you not do?
  • What is your fee, when is it due, and what happens to it if the lender declines?
  • Will I pay settlement money only to the lender's own account? (The answer must be yes.)
  • How will you use and protect my documents and personal details?
  • Can I speak to my lender directly at any time?
  • How do I make a complaint about your service?

Verify every offer with the lender

Whoever you work with, any settlement offer should come from the lender in writing, with your account number, the agreed amount, the payment deadline and the account to pay into. Confirm it through the lender's official helpline, branch or portal, not only through the number the company gives you. Use our settlement letter checklist before you pay, and keep every receipt.

After you finish paying, ask for the no-dues certificate or NOC and check your credit report later.

You can also do it yourself

Nothing stops you from writing to your lender yourself. Our guide to the settlement request letter format explains what the letter does, and how personal loan settlement works explains the steps. Be wary of anyone who says you cannot approach your lender directly. A consultancy is worth considering only if it adds something you cannot easily do yourself.

How Debt Support Expert works

We are a loan settlement consultancy. We are not a lender and not a law firm. We never collect settlement money, because any amount you agree is paid by you directly to your lender. The lender alone decides the result. Our fees depend on your case and are explained before you decide to proceed. You can request a loan settlement case review and ask us all of the questions above.

More scam red flags to watch for

Confirm any offer directly with the lender through its official website or branch. Report suspicious entities on RBI's Sachet portal, and fraud on cybercrime.gov.in or 1930. To see how we work and what we charge before you decide, read loan settlement help.

  • Requests for OTPs, PINs, net-banking passwords or remote-access apps.
  • Fake letterheads, or "offers" sent from personal Gmail or WhatsApp numbers.
  • Pressure to decide today.
  • Claims to be a law firm or "RBI-approved". RBI does not approve settlement consultants.

Frequently Asked Questions

Are loan settlement companies safe?

Some are careful and honest, and some make promises they cannot keep. Check for the red flags in this guide, ask for fee terms in writing, and never pay settlement money to anyone but your lender.

Should I pay a settlement company before the lender agrees?

Ask for the fee terms in writing first, including what happens if the lender declines. Never send the settlement amount itself to the company. It must go to the lender's own account.

Can a company remove "settled" from my CIBIL report?

No. Accurate information cannot lawfully be removed. You can only dispute information that is wrong. Be wary of anyone who promises otherwise.

Can a company stop recovery calls?

No company can promise that. Lenders can still contact you within RBI's rules, and harassment can be complained about. See our guide on recovery agent complaints.

Do I need a settlement company at all?

No. You can ask your lender for a settlement yourself. A consultancy may help if you want support with documents, planning and the conversation, but the result is still the lender's decision.
