FAQs

Loan Settlement FAQs

Quick answer: loan settlement means your lender agrees to accept less than the full dues to close an account. The lender decides. Below are simple answers on the process, recovery agents, legal notices, CIBIL and our fees.

Settlement Basics

Is loan settlement legal in India?

Yes. Banks and NBFCs can agree compromise settlements under their own board-approved policies, within the RBI framework on compromise settlements issued in June 2023. Whether to offer a settlement, and on what terms, is the lender's decision.

What is the difference between settlement and restructuring?

Restructuring usually changes the loan terms, such as a longer tenure or a lower EMI, and you still repay the full amount. A settlement is when the lender agrees to accept less than the full amount due as full payment of the account. The account is usually shown as "settled", not "closed". Settlement may be possible depending on your financial circumstances, the lender's decision, and the terms offered. No settlement amount or outcome is guaranteed.

Is loan settlement good or bad?

It depends on your situation. Settlement can stop dues growing and may reduce what you pay, but the account is usually shown as "settled" and not "closed", which lenders read as a negative, and the lender does not have to agree. If you can still pay in full or agree an EMI plan, that is usually better for your credit report.

What percentage will a bank settle for?

There is no fixed percentage. RBI's June 2023 rules ask every bank and NBFC to set how much it can reduce in its own board-approved policy, so the figure depends on the lender, your account and what you can pay. We do not quote or promise any percentage.

Should I stop paying my EMIs to get a settlement?

No. Stopping payments you can afford adds penalties, harms your credit report, and can lead to legal action. Settlement is meant for genuine hardship.

Recovery Agents & Your Rights

What hours can recovery agents call?

RBI guidance says recovery agents should generally call between 8:00 AM and 7:00 PM, and must not threaten, abuse or harass you.

Can recovery agents contact my relatives, employer or friends?

RBI rules say agents must not harass or humiliate borrowers, including by contacting family, friends or colleagues to shame them. Keep a record of every such contact.

How do I complain about harassment?

Complain in writing to the lender first. If it does not resolve the complaint within 30 days, or you are not satisfied with the reply, you can complain to the RBI Ombudsman at cms.rbi.org.in. For threats or criminal intimidation, you can report to the police. We can help you write these complaints.

Can I be arrested for not paying a loan?

Not repaying a loan is generally a civil matter. Some situations, such as a bounced cheque under Section 138 of the Negotiable Instruments Act, or allegations of fraud, can lead to criminal proceedings. If you have received a notice, get advice quickly.

Credit Report

How does settlement affect my credit score?

A settled account is usually reported to credit bureaus as "settled" rather than "closed". This can lower your score and make new credit harder to get for some time.

Can I change "settled" to "closed" on my credit report?

Sometimes, but it is the lender's decision. The usual route is to ask the lender whether it will accept the amount that was waived, pay it only if the lender agrees in writing, get a no-dues certificate or NOC, and ask the lender to update the credit bureau. If the report is still wrong, you can raise a dispute with the bureau, which asks the lender to confirm and can take around 30 days. Accurate history cannot be removed, and nothing is guaranteed.

Can I get a new loan after settling?

It may be harder for some time, and each lender decides based on its own policy. Paying all your other dues on time helps your credit history over time.

Payments, Documents & Fees

Where do I pay the settlement money?

Always directly to your lender's official account. Debt Support Expert never collects or handles settlement money.

What documents should I get?

Before paying, get the settlement terms in writing from the lender. After paying, ask for a closure or no-dues letter.

What do I need to get started?

Basic details of your loans or cards, recent statements if you have them, any notices you received, and a short explanation of your financial situation.

Is it safe to use a loan settlement company?

Be careful with any company that promises a result, asks you to send settlement money to it or to a personal UPI ID, or tells you to ignore notices. Ask for fee terms in writing before you pay anything, and confirm settlement terms directly with your lender. We never collect settlement money and we cannot guarantee any outcome.

What does your service cost?

Fees depend on your case and are explained clearly, in writing, before you decide to proceed. Settlement money goes directly to your lender, never to us. See our Plans & Pricing page at debtsupportexpert.com/pricing.
