Recovery Agent Complaint Letter: Why It Matters and How It Protects You

A recovery agent complaint letter will not cancel your loan. It creates a dated written record, makes your lender examine the conduct, and becomes the proof you need before the RBI Ombudsman.

Quick answer

A recovery agent complaint letter will not cancel your loan. It matters because it creates a dated, written record of the agent's conduct, makes your lender examine it through its grievance process, and becomes the proof you need before approaching the RBI Ombudsman if the lender does not reply within 30 days or the reply does not help.

Why the letter matters

A written complaint helps in four practical ways:

  • A record that can't be denied. A phone argument leaves nothing behind. A dated complaint with your call log and screenshots does.
  • Your lender answers for its agent. RBI's circular of 12 August 2022 says lenders remain responsible for the conduct of the recovery agents they engage.
  • It opens the escalation route. The RBI Ombudsman will not take a complaint unless you first approached the lender and can show proof of it.
  • It separates the debt from the behaviour. You can say clearly that you are not denying the loan, only objecting to how it is being recovered. That keeps the door open for repayment or loan settlement talks.

What it cannot do: it does not cancel, reduce or pause your dues; it does not stop lawful reminders within permitted hours; and it does not stop notice deadlines or legal action the lender is entitled to take.

The legal protection behind it

Rules in force today (RBI/2022-23/108, 12 Aug 2022). Lenders and their agents must not call before 8:00 AM or after 7:00 PM to recover overdue loans; must not make persistent, threatening or anonymous calls; must not intimidate, harass or publicly humiliate you or intrude on the privacy of your family, referees and friends; and must not send inappropriate messages or make false or misleading statements. The circular covers banks (except payments banks), co-operative banks, NBFCs including housing finance companies, all-India financial institutions and ARCs.

Rules from 1 January 2027. RBI's amendment directions of 6 August 2026 apply to commercial banks, small finance, local area and regional rural banks, urban and rural co-operative banks, AIFIs, NBFCs and housing finance companies. For commercial banks (RBI/2026-27/223) they say, among other things, that an employee or agent may contact or visit you only between 08:00 and 19:00 hours; the bank must publish its list of recovery agencies on its website; the bank must tell you the recovery agency's details at least one day before the agency's first in-person visit; and agents must show identity cards issued by the bank and the agency.

Where the complaint goes next. If the lender does not reply within 30 days, or you are not satisfied, you may complain to the RBI Ombudsman at cms.rbi.org.in, free of charge, within 90 days of the end of that 30-day period or of the lender's last reply, whichever is later. The Ombudsman scheme covers banks and larger NBFCs but not housing finance companies or NBFCs below the ₹100 crore asset threshold; see our RBI Ombudsman complaint guide. Threats of violence, extortion or misuse of your photos or contacts are police matters (cybercrime.gov.in for online misuse).

Not every recovery call is unlawful. Lenders may ask you to repay; the rules govern how they do it.

When you need one

A written complaint usually makes sense when:

  • Calls before 8 AM or after 7 PM, or many calls in a day
  • Abusive, threatening or insulting language
  • Calls or messages to family, friends or your employer to shame you
  • Home or office visits that frighten you, or agents who won't say which agency they are from
  • False claims such as "police will arrest you today" over an unpaid loan
  • Messages to your phone contacts or misuse of your photos (see the loan app harassment guide)

Example: say an agent called you at 9:30 PM twice in one week and then phoned your office. That is a specific, dated pattern the lender can be asked to stop, and the kind of situation where a written complaint matters.

You usually don't need one for a single polite reminder during permitted hours. A legal notice needs its own response: see how to reply to a bank legal notice.

Why we don't publish a copy-paste letter

A complaint is only as strong as your own facts and evidence, so we do not publish templates, sample letters or step-by-step drafting. When you work with us, we help you organise your evidence and explain your rights; for a formal legal reply you should use a lawyer of your choice.

Frequently Asked Questions

Does a complaint letter stop recovery harassment?

It makes the lender look into its agent's conduct and often leads to calmer contact, but it cannot promise that all calls stop. Lawful reminders within permitted hours may continue.

Is there a deadline for the RBI Ombudsman?

Yes: 90 days from the end of the lender's 30-day reply period or from its last reply, whichever is later.

Can I complain to the Ombudsman about a housing finance company?

Not under RB-IOS 2026, which excludes HFCs. Complain to the company's grievance officer; RBI says such complaints may go to other grievance arrangements.

Can I go straight to the Ombudsman?

No. You must complain to the lender first and show proof.

Will complaining affect a loan settlement?

A conduct complaint is separate from what you owe. Any settlement remains the lender's decision.

Do the 2027 rules apply to NBFCs?

Yes. RBI issued matching amendment directions for NBFCs and HFCs, effective 1 January 2027.
