Quick answer: what happens if you miss personal loan EMIs

After a missed EMI the lender adds late charges and starts reminders. If dues stay unpaid for more than 90 days, the loan becomes an NPA, your credit report shows the default, and recovery calls and legal notices usually increase. Not paying a loan is generally a civil matter, not a crime.

  • Recovery agents may call only between 8 AM and 7 PM, and must not threaten, abuse or shame you (RBI circular RBI/2022-23/108, 12 August 2022).
  • An agent who visits must carry an identity card and the lender's authorisation letter (RBI recovery agent guidelines, 2008).
  • If full repayment is not possible, a personal loan defaulter can ask the lender about restructuring or a one-time settlement. The lender decides.

First, the reassurance: default is usually a civil matter

If you cannot pay your personal loan EMIs because your income has fallen, you are not a criminal. In India, failure to repay a loan is generally a civil matter between you and the lender. The lender can pursue recovery through lawful means, but it cannot threaten you with arrest for non-payment alone, and recovery agents are bound by RBI rules on conduct.

That said, ignoring the problem makes it worse. Charges keep accumulating, your credit report deteriorates, and legal notices that require a response may arrive. Understanding the sequence helps you act at the right time.

The timeline: from a missed EMI to NPA

Banks and NBFCs track overdue accounts using categories defined in RBI's prudential norms. The exact operational steps vary by lender, but the broad classification is the same:

Penal charges, not penal interest

Under RBI's directions on penal charges in loan accounts (issued in August 2023 and applicable from 2024), regulated lenders may levy reasonable penal charges for default, but should not add them as penal interest to the interest rate or compound them. Check your loan statement for how charges are applied.

  • Day 1 onwards: the EMI is overdue. The lender may contact you by SMS, email and phone, and charges for late payment may apply as per your loan agreement.
  • SMA-0: principal or interest overdue for up to 30 days.
  • SMA-1: overdue for more than 30 days and up to 60 days.
  • SMA-2: overdue for more than 60 days and up to 90 days.
  • NPA: overdue for more than 90 days. The account is classified as a non-performing asset in the lender's books, and recovery efforts usually intensify.

What happens to your credit report

Lenders report repayment data to credit bureaus such as TransUnion CIBIL, Experian, Equifax and CRIF High Mark. Each missed EMI is recorded as days past due (DPD) against that month. As overdue days increase, the account may be shown as substandard or doubtful, and later as written off or settled depending on what happens next.

This history affects your ability to get new loans, credit cards and sometimes even rental or employment checks that use credit information with consent. Late payments typically stay visible in the payment history for several years, though their weight reduces as newer, on-time payments are added.

Recovery calls and visits: what is allowed

A lender may remind you about an overdue personal loan. What it may not do — calling before 8 AM or after 7 PM, threatening you, or shaming your family — is explained, with the complaint steps, in recovery agent harassment. For a home or office visit, see can a recovery agent visit your home or workplace. The extra notice rules that start on 1 January 2027 are in RBI recovery agent rules from 2027.

Legal options available to the lender

Because a personal loan is unsecured, the lender has no specific asset to seize. To recover the money through the legal system, it generally has to use one of these routes:

  • A civil recovery suit, including a summary suit, and then execution of any decree the court passes.
  • Arbitration, if your agreement has a clause — you can take part and challenge an award on the grounds the law allows.
  • A Debts Recovery Tribunal case, for banks and certain institutions where the debt is ₹20 lakh or more.
  • A Lok Adalat referral. Participation is voluntary; if both sides agree, the award is treated as a civil-court decree.

What does NOT apply to an unsecured personal loan

Borrowers are often frightened by threats that have no basis for an ordinary personal loan. Two common examples:

SARFAESI Act: the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 lets secured creditors take possession of secured assets without going to court first. It applies to secured debt, such as a home loan or loan against property. An unsecured personal loan has no security interest, so SARFAESI enforcement does not apply to it.

Section 138 of the Negotiable Instruments Act, 1881: this is a criminal provision about dishonoured cheques, not about loan default as such. It comes into play only if a cheque you issued (for example, a post-dated or security cheque for repayment of a legally enforceable debt) is presented and bounces. A similar provision, Section 25 of the Payment and Settlement Systems Act, 2007, covers dishonour of electronic mandates such as ECS or NACH. If you have not given cheques or a mandate, or none has been presented and dishonoured, these provisions do not arise.

If you receive a Section 138 or Section 25 notice

Do not ignore it. The law gives a short window to respond: under Section 138, the drawer has 15 days from receipt of the notice to pay the cheque amount before a complaint can be filed. Read our guide on responding to Section 138 notices and take legal advice promptly.

Fraud allegations and criminal threats

Recovery agents sometimes threaten borrowers with criminal cases for cheating or fraud. Not being able to pay because of genuine hardship is not, by itself, cheating. Criminal law may be relevant only where there is something more, such as a loan taken using forged documents or with dishonest intent from the beginning. Courts have repeatedly distinguished civil disputes about repayment from criminal offences.

Note that the Indian Penal Code was replaced by the Bharatiya Nyaya Sanhita, 2023 from July 2024; agents who quote old IPC sections at you are often relying on scare tactics rather than facts. If you receive any legal notice or summons, read it carefully and consult a lawyer.

Limitation: can the lender sue years later?

Under the Limitation Act, 1963, a suit to recover a loan generally has to be filed within three years from when the right to sue arises. However, the period can restart if you acknowledge the debt in writing or make a part payment within the limitation period, and arbitration and other proceedings have their own rules. Do not rely on limitation as a strategy without legal advice; the facts matter.

What you should do if you can't pay

A practical plan for borrowers under pressure:

  • Contact the lender in writing before or soon after the first missed EMI, explain the hardship, and ask about restructuring, a temporary EMI reduction or a payment holiday.
  • Keep paying whatever you realistically can on secured loans first, as they carry the risk of losing the asset.
  • Keep a log of every recovery call and message; complain in writing to the lender if conduct breaches RBI rules.
  • Respond to every legal notice within the time it specifies, with legal help if needed.
  • If full repayment is not realistic, explore a documented one-time settlement. See how personal loan settlement works.
  • If the lender does not resolve a complaint within 30 days, or rejects it, you can escalate to the RBI Ombudsman at cms.rbi.org.in.

What NPA does — and does not — mean

NPA is a label in the lender's books when an instalment on a standard term loan stays overdue for more than 90 days. It does not cancel the debt, wipe out interest or charges, or give you an automatic right to a settlement. The lender may still recover what you owe.

The change is not always stamped at midnight on day 90. Lenders classify accounts in their day-end process, so the exact date depends on your due date and their rules. Cash-credit and overdraft accounts often use a separate "out of order" test, and some farm loans follow the crop season rather than a simple 90-day count.

Recovery calls and letters can start after the first missed EMI, well before an account becomes NPA. Those contacts must still follow RBI conduct rules. SMA-2 also does not mean you have been arrested or that your home has been taken — it is only a stress category on the way to NPA.

Frequently Asked Questions

Can a personal loan defaulter settle the loan?

You can ask. Lenders usually consider a one-time settlement when the account is overdue and you can show real hardship. The lender decides under its own policy, the account is usually reported as "settled", and you should pay only after getting the offer in writing.

Can I be arrested for not paying a personal loan in India?

Non-payment of a loan because of financial hardship is generally a civil matter, and a lender or agent cannot have you arrested simply for default. Criminal proceedings can arise in specific situations, such as a dishonoured cheque under Section 138 of the Negotiable Instruments Act or genuine fraud. Take legal advice if you receive any summons.

When does a personal loan become an NPA?

Under RBI prudential norms, a loan account is classified as a non-performing asset when principal or interest remains overdue for more than 90 days. Before that, lenders track it as SMA-0 (up to 30 days), SMA-1 (31 to 60 days) and SMA-2 (61 to 90 days).

Can the bank seize my house or salary for an unsecured personal loan?

Not on its own. SARFAESI applies only to secured debt, so there is no asset to take without going through a legal process. A lender would first need a court decree or an enforceable arbitration award, after which execution measures such as attachment can be ordered according to law.

Is it legal for agents to call my family about my loan?

RBI directions prohibit recovery agents from harassing or humiliating borrowers, including contacting relatives, friends or colleagues to shame or pressure them, and from calling before 8:00 AM or after 7:00 PM. Record such calls and complain in writing to the lender, then to the RBI Ombudsman if unresolved.

Should I settle or restructure a defaulted personal loan?

If you can repay in full over a longer period, restructuring usually protects your credit profile better. Settlement is generally considered when full repayment is not realistic. The right choice depends on your income, other obligations and the lender's policy.

Does NPA mean the bank has written off or waived my loan?

No. NPA means the account is classified as non-performing. The amount is still payable unless the lender later agrees a written settlement or you repay in full.

Will my loan become NPA on the day I miss a third EMI?

Not automatically on that calendar day. For many term loans the test is whether principal or interest has been overdue for more than 90 days, applied in the lender's day-end classification.
