Quick answer
A “lien”, “freeze”, “hold” or “set-off” on a bank account are not identical things, and banks use the words loosely. A freeze or debit-block can also come from a court order, a police or tax request, a KYC alert or an investigation — not only from your loan.
A banker’s right of set-off, where it applies, is generally the bank adjusting a credit balance towards a debt that is due to it, typically when the money is held in the same right (you as borrower, the bank as creditor). It is not an automatic right over every joint account, every family member’s money, or funds the bank holds only as a trustee. Ask for the legal and contractual basis in writing. There is no single RBI circular that says “a lender may freeze any account at any time.”
What is the difference between a lien, a freeze and set-off?
In everyday banking talk:
Whether the bank can touch a particular balance depends on the account type, who owns it, why the money is there, and any court order. Do not assume the worst or the best from a recovery agent’s threat.
- Lien — a recorded claim over money or an asset until a debt is paid. Whether your bank has one depends on the account terms, any security you signed, and the facts.
- Freeze / hold / debit restriction — you cannot withdraw or pay out as usual. The reason should be explained by the bank. Reasons differ widely.
- Set-off — the bank applies a credit balance against a sum you owe it. Courts in India have long recognised a banker’s set-off in appropriate cases; it still depends on the accounts being in the same right and the debt being due.
Can a bank take money from a joint account or another account in the same bank?
Sometimes a bank will look at other accounts you hold with it if the loan agreement or a general right of set-off allows it. A joint account is more sensitive: the other holder’s share and the purpose of the account matter. Money credited only as a salary to be passed on, or held for someone else, may not be treated the same as your sole surplus.
Do not rely on a recovery agent’s claim that “we will empty every account today.” Ask the bank, in writing, which account was marked, from which date, under which clause or order, and how you can get a partial release for essential living expenses if a restriction has been placed.
What should you do if your account is marked or frozen?
- Download or photograph the SMS, app message or branch note. Write down the date and the amount you cannot use.
- Email the bank’s customer care and grievance redressal officer with your account number and loan account number. Ask for a written explanation: lien, freeze, set-off, court order or something else.
- Ask for a copy of any internal instruction or external order the bank relies on.
- If a set-off has already happened, ask for the calculation (which debt, which credits, remaining balance).
- Keep paying — or writing about — the loan through official channels so the dispute about the account and the repayment discussion both have a paper trail.
- If the reply is missing or unsatisfactory after the bank’s grievance timeline (often 30 days for an Ombudsman route), you may complain at cms.rbi.org.in if the bank and the complaint are covered under the Reserve Bank – Integrated Ombudsman Scheme.
What documents help?
- Account statement before and after the restriction.
- The loan agreement pages on security, set-off or lien, if you have them.
- Salary credits or other proof if you argue the money was not available for set-off.
- All emails to the bank and any acknowledgement numbers.

Frequently Asked Questions
Is every account freeze after default legal?
Not automatically. The bank must have a lawful basis — contract, a recognised set-off in the same right, or an external order, among other possibilities. Ask for that basis in writing.
Can a recovery agent freeze my account?
A recovery agent cannot personally freeze a bank account. Only the bank (or a lawful order the bank must follow) can restrict an account. If an agent claims they have frozen it, verify with the bank on an official number.
Does a freeze cancel my loan?
No. A restriction on an account is separate from the loan balance, which remains payable unless the lender agrees a written settlement or you repay.
What if the bank will not explain the freeze?
Use the grievance officer, then the Principal Nodal Officer if needed, then the RBI Ombudsman at cms.rbi.org.in when the scheme applies.
